Assignment of trademarks

For taking legal effect, assignment and licensing of a trademark should be registered and recorded.


Requirements for recording of an assignment are:

  1.  A power of attorney signed by the assignee certified and legalized by the Iranian Consulate.
  2.  A deed of assignment certified and legalized by the Iranian Consulate.
  3.  Valid Iranian certificate of trademark registration or renewal for endorsement.

Change of address of trademark owner

In order to guarantee continued legal protection, every changes and modifications should be formally registered.


Required documents for change of address are:

  1.  A power of attorney signed by the assignee certified and notarized by the Iranian Consulate.
  2. Certified copy of change of address document.
  3. Valid Iranian Certificate of Trademark registration or renewal for recording change of address.

Change name of trademark owner

For taking legal effect, assignment and licensing of a trademark should be registered and recorded.


Requirements  recording of change of name are:

  1.  A power of attorney signed by the assignee certified and notarized by the Iranian Consulate.
  2. Change of name document certified and notarized by the Iranian Consulate.
  3. Valid Iranian Certificate of Trademark Registration or Renewal for endorsement.

Recording of licenses

Any trademark owner has the right to license their trademark to other parties on agreed terms and conditions.


License would be recorded on the presentation of the following documents:

  1. Licensing Agreement signed by both parties, notarized and then legalized by the Iranian consulate.
  2. A power of attorney from the Licenser and Licensee, notarized and then legalized by the Iranian consulate.
  3. Valid Iranian Certificate of Registration for endorsement of the Licensing agreement.

Change of the mark or classification

Proprietor of a trademark has the legal right to change the mark itself or the classification it refers to. In order to guarantee continued legal protection, every changes and modifications should be formally registered.


Requirements are:

  1.  A power of attorney signed by the assignee certified and legalized by the Iranian Consulate.
  2. Certified copy of change of mark or classification document
  3. Valid Iranian Certificate of Trademark Registration or Renewal for endorsement.
  4. Changes of the mark itself requires ten samples of the new mark.

Registration of collective marks

According to the Patents & Trademarks Registration Regulations, c.1, article 2(5), collective marks are registrable. Registration and examination procedure for a collective mark is in the same manner as other trademark or service mark applications. In addition to general filing particulars required for all trademark or service mark applications, applicants must provide either a notarized certificate issued by the competent authority attesting the right of use of the mark by the manufacturers for the goods covered by the mark or home or any other country’s collective mark registration certificate, certified by the issuing Office.


Requirements for filing a collective mark are:

  1. The full name and address of the applicant.
  2. Specification of goods and/or services and related classes.
  3. A sample of the mark. For three-dimensional marks the applicant must provide sufficient dimensions of the mark to be clearly represented.
  4. A power of attorney certified and notarized by the Iranian Consulate.
  5. A notarized certificate issued by a competent authority attesting the right of use of the mark by the manufacturers for the goods covered by the mark OR home or any other country’s registration certificate, certified by the issuing Office.

Registration of trademarks

A trademark registration is effective for a period of ten years from the filling application form and may be renewed for similar periods.

Effective June 16, 2003 the Trademark Office adopted the 8th edition of international classification of goods and services.

According to Islamic codes, alcoholic beverages which are included in class 33, “beer, ale and porter” in class 32 and all trademarks comprising portraits of “Women” in any form, are prohibited for registration and renewal in Iran.


Requirements for filing a trademark application in Iran are:

  1. The full name and address of the applicant.
  2. List of goods and/or services and related classes.
  3. A sample of the mark. For three-dimensional marks the applicant must provide sufficient dimensions of the mark to be clearly represented.
  4. A power of attorney certified and legalized by the Iranian Consulate.
  5. Certified copy of home or abroad registration or application.

Renewal of trademarks

A trademark may be renewed every 10 years from the date of the original application or six months before expiration date there is a six month grace period after the expiration date.


The required documents for renewal of a trademark are: 

  1.  A power of attorney certified and notarized by the Iranian Consulate.
  2.  A copy of the Iranian Certificate of Registration or Renewal.

Three-dimensional marks

The IIPO has recently adopted a new rule for registration of three dimensional marks, based on article 2(2) of the Patents & Trademarks Regulations.

Registration and examination procedure for a three dimensional mark is in the same manner as other trademark or service mark applications.


Requirements for the filing of a three-dimensional mark are: 

  1.  The name and address of the applicant.
  2.  Specification of goods and related classes.
  3.  A sample of the mark. The applicant must provide sufficient dimensions of the mark to be clearly represented.
  4.  A power of attorney certified and notarized by the Iranian Consulate.
  5.  Certified copy of home or abroad registration or application.
