Annuity

If the annuity fee for a year has not been paid in advance, it should be settled within the first three months of the year, otherwise the patent shall become invalid, unless the inventor pays double the amount within the next three months of the year.

Full or partial payment of the annuity fees is also possible and may be paid at the time of issuance of the registration certificate. In case of payment of five annuities, a discount of 5%, for ten annuities, 10% discount, for fifteen annuities 15% and for full payment of annuities,  20% discounts on official tax is available.

Registration of patents

Patents are granted for 10, 15, or a maximum period of 20 years, according to the discretion of the applicant. One of these time spans must be specified in the certificate.


Requirements for registration of a patent are:

  1. The full name and address of the applicant.
  2. The title of the invention.
  3. Certified copy of priority documents or abroad registration.
  4. A power of attorney certified and legalized by the Iranian Consulate.
  5. A copy of the deed of assignment certified and notarized by the Iranian Consulate. An assignment form is only necessary if the priority document is in the name of the inventor and the applicant is different from the inventor. However, if the inventor is not mentioned in the priority document and the priority document is in the name of the applicant, there is no need for an assignment form.
  6. A set of specifications, claims and drawings.

Recordal of licensing patent

A patent owner has the right to license their patent to other parties on agreed terms and conditions.


License would be recorded on the presentation of the following documents:

  1. Licensing Agreement signed by both parties, notarized and legalized by the Iranian consulate.
  2. A power of attorney from the License issuer and Licensee, notarized and legalized by the Iranian consulate.
  3. Valid Iranian Certificate of Registration for endorsement of the Licensing Agreement.

Change of Name/Address of Patent Owner

For taking legal effect, the change of name or address of patent owner should be registered and recorded.


Requirements for Change of Name of Patent Owner are:

  1. A power of attorney certified and legalized by the Iranian Consulate.
  2. Change of name document certified and legalized by the Iranian Consulate.
  3. Certificate of the granted Iranian patent for endorsement.

Assignment of patents

Inventor or discoverer is authorized to assign or transfer the patent and any legal interest in it to a third party. A patent can also be consigned through inheritance.


Requirements for the assignment of a patent are:

  1. A power of attorney signed by the assignee certified and legalized by the Iranian Consulate.
  2. A deed of assignment certified and notarized by the Iranian Consulate.
  3. Certificate of the granted Iranian patent for endorsement.
